This Privacy Policy explains how Silver Brush Cleaning collects, holds, uses and discloses personal information, in line with the Australian Privacy Principles (APPs) under the Privacy Act 1988 (Cth).
Who we are and what this Policy covers
Md Shafin Rahman, ABN 35 957 531 833, an individual/sole trader trading as Silver Brush Cleaning (Silver Brush, we, us or our), provides residential and commercial cleaning services and operates silverbrushcleaning.com.au.
This Privacy Policy explains how we collect, hold, use and disclose personal information about customers, prospective customers, Website visitors, property contacts, suppliers, job applicants, Cleaners and other people who deal with us.
To the extent the Privacy Act 1988 (Cth) and Australian Privacy Principles (APPs) apply to us, we comply with them. If a small-business exemption applies to a particular activity, we nevertheless intend to handle personal information consistently with this Policy as a service commitment, subject to any lawful exception.
What personal information we collect
Depending on how you deal with us, we may collect:
- identity and contact details, such as name, company, email, phone and billing contact;
- premises and service details, including address, room count, property condition, checklists, photographs, access instructions, keys, alarm or lockbox information and parking details;
- booking, quote, invoice, payment-status, discount, complaint, re-clean and service-history information;
- payment information processed by our payment provider, such as a payment token, transaction reference and limited card details; we do not store a full card number or security code;
- communications with us, including email, SMS, call notes, webchat, reviews and feedback, and a call recording if we first give any notice required by law;
- safety, allergy, accessibility or health-related information you choose to give us where it is reasonably necessary to provide the Service safely;
- before-and-after, damage, access or quality-assurance photographs and video;
- marketing preferences, referral source, promotion use and consent records;
- Website and device information, such as IP address, browser, pages viewed, date/time, approximate location, referring page, cookie identifiers and interaction data;
- for suppliers, applicants and Cleaners, relevant business, identity, work-history, licence, insurance, right-to-work, police/background-check, payroll and banking information; and
- information required or authorised by law, an insurer, a regulator or a court.
We do not intentionally collect more personal information than reasonably necessary for our functions and activities.
How we collect information
We usually collect information directly from you when you browse the Website, request a quote, make or manage a booking, pay, contact us, provide a checklist, submit a review, make a complaint, apply for work or interact with a Cleaner.
We may also collect information from a person booking on your behalf; a property manager, landlord, tenant, employer, building manager or emergency contact; a referral partner or booking platform; a Cleaner; our payment and technology providers; publicly available sources; or an authority where lawful.
If you give us another person's information, you must be authorised to do so and, where practicable, tell them about this Policy. If we receive information from elsewhere and the person may not reasonably expect it, we will take reasonable steps to notify them as required.
Why we collect, use and disclose information
We may handle personal information to:
- respond to enquiries and prepare quotes;
- confirm, allocate, provide, reschedule and support Services;
- give a Cleaner necessary address, scope, access and safety information;
- process payments, issue invoices, prevent fraud and recover lawful debts;
- communicate arrival information, service updates and emergency issues;
- verify work, administer re-cleans, investigate complaints and manage damage or insurance claims;
- maintain service, safety, security, accounting, tax and legal records;
- improve our checklists, training, customer service, Website and business operations;
- manage suppliers, applicants, Cleaners and workplace obligations;
- send marketing where we have the consent or other lawful basis required and maintain suppression lists after opt-out;
- enforce contracts, protect people or property, and investigate suspected unlawful conduct; and
- comply with law, a court or tribunal order, or a lawful request from an authority.
If you do not provide information needed for a booking, we may be unable to quote accurately, access the premises, process payment, manage safety or provide some or all of the Service. Optional marketing information is not required to receive cleaning Services.
Sensitive information
Sensitive information includes health information, criminal-record information and certain information about race, beliefs, associations and biometrics. We collect sensitive information only with consent where consent is required, where it is reasonably necessary for our functions, or where another legal permission applies.
For example, a customer may tell us about an allergy or accessibility need, and an applicant or Cleaner may provide a police-check result where lawful and relevant. We restrict access and use that information only for the purpose collected or another purpose permitted by law.
Premises photographs and recordings
Cleaners may take limited photographs or video where reasonably necessary to record pre-existing condition, access restrictions, safety concerns, completed work, a re-clean issue or a damage claim. We aim to exclude people, personal documents, family photographs, security information and unrelated possessions.
We do not use identifiable premises material, customer names, testimonials or logos for advertising without separate permission. Quality and claim records are retained only for as long as reasonably needed for their purpose and any legal or insurance requirement.
Payment information
Payments may be processed by our third-party payment provider. The processor may collect and handle payment details under its own privacy policy and security standards. Silver Brush retains only the transaction information reasonably needed for receipts, refunds, disputes and accounting, not a full card number or card security code.
Do not send card details, passwords or access codes through an insecure channel when a secure alternative is offered.
Who we disclose information to
We may disclose relevant information to:
- employees and Cleaners who need it to provide or support the Service;
- payment processors, banks and fraud-prevention providers;
- Website hosting, online-form, booking, CRM, cloud storage, email, SMS, telephone, analytics, mapping and IT-security providers;
- property managers, landlords, tenants, employers or booking contacts where authorised or reasonably necessary to manage their booking;
- insurers, brokers, accountants, auditors, lawyers, debt-recovery providers and other professional advisers;
- emergency services, police, regulators, courts and government agencies where required or authorised by law or reasonably necessary to address a serious threat; and
- a buyer or adviser involved in a genuine proposed sale or restructure of the business, subject to confidentiality and applicable law.
We do not sell personal information. We require service providers to handle information for the agreed purpose and with appropriate confidentiality and security, to the extent reasonably practicable.
Overseas access and storage
Some technology and support providers may store or allow access to personal information outside Australia. The APPs require an accurate policy statement about likely overseas disclosures and, where practicable, the countries involved.
Silver Brush is likely to disclose personal information to recipients in the United States, where our website hosting, mapping and font infrastructure providers are based. We will update this statement if our provider configuration changes.
Where the Privacy Act applies, we will take reasonable steps in relation to overseas disclosures as required by APP 8, subject to lawful exceptions.
Website, cookies and embedded services
The Website may use cookies, pixels, local storage and similar technologies for security, essential functions, preferences, forms, performance measurement and, only where implemented, advertising.
At the date of this policy, the Website loads resources associated with Webflow infrastructure, Google-hosted fonts and embedded Google Maps, content-delivery networks and media hosts. Those providers may receive device or usage information when their content loads. Their own privacy notices apply to their handling.
You can adjust browser settings to block or delete cookies, but some Website functions may not work correctly. If Silver Brush adds non-essential advertising or cross-site tracking, we will update this Policy and implement an appropriate consent or preference mechanism before activation.
Direct marketing
We may send promotional email or SMS only where we have the consent or other lawful basis required. Marketing messages will identify Silver Brush, include a clear and functional unsubscribe method, and we will action an electronic unsubscribe request within five working days as required by the Spam Act 2003 (Cth).
You may opt out at any time using the message link or by contacting us. Opting out of marketing does not stop necessary quote, booking, payment, safety or service communications. We may keep a minimal suppression record so that we do not contact you again by that channel.
Telephone marketing, if used, must comply with applicable consent, identification, calling-time and Do Not Call Register requirements.
Anonymity and pseudonyms
You may deal with us anonymously or using a pseudonym where practicable and lawful, such as making a general enquiry. We will need accurate identity, contact, address, access and payment information to confirm and safely perform most Services.
Security
We take reasonable administrative, technical and physical measures appropriate to the information and risks. Measures may include role-based access, confidentiality duties, staff and contractor training, multi-factor authentication, secure payment processing, access logging, software updates, backups, device protections and secure destruction.
No internet transmission or storage system is completely secure. You should notify us immediately if you believe a booking account, key, alarm code or other credential has been compromised.
Access instructions and security codes should be shared only with the Cleaner and support staff who need them, and deleted or de-identified as soon as they are no longer required.
Retention and destruction
We keep personal information only for as long as reasonably needed for the purpose collected, dispute and insurance periods, and legal, tax and accounting obligations. Typical business and invoice records may need to be kept for up to seven years. Temporary access details are removed promptly after the booking or recurring access arrangement ends. Claim records may be kept while a claim or legal limitation period remains relevant.
When information is no longer required, we take reasonable steps to delete, securely destroy or de-identify it, subject to backups and lawful retention.
Data breaches
We maintain a process to contain, investigate and respond to suspected data breaches. Where the Notifiable Data Breaches scheme applies and a breach is likely to result in serious harm, we will notify affected individuals and the Office of the Australian Information Commissioner as required by law.
Access and correction
You may ask for access to personal information we hold about you or ask us to correct it. Contact the Privacy Officer using the details below and describe the information concerned. We may verify your identity before releasing information.
We will respond within a reasonable period and generally do not charge for making a request. If a lawful exception permits us to refuse access or correction, we will ordinarily give written reasons and available complaint options. A reasonable charge may apply to providing access where the law permits and we tell you in advance.
Privacy complaints
Send a privacy concern to support@silverbrushcleaning.com.au with enough detail for us to investigate. We will acknowledge it within a reasonable time, aim to respond within 30 days and explain any delay.
If you are not satisfied, you may contact the Office of the Australian Information Commissioner at oaic.gov.au where it has jurisdiction. You may also have rights to contact another regulator or obtain independent advice.
Children
Bookings must be made by an adult authorised to access the premises. We do not knowingly market to or create booking accounts for children. We may incidentally receive information about children where a customer discloses household or safety needs; we use only what is reasonably necessary for the Service.
Third-party sites and social media
Links, embedded maps, social-media pages and third-party booking or payment services have their own terms and privacy practices. This Policy applies to Silver Brush's handling of information, not a third party's independent handling. Review the third party's notice before providing information directly to it.
Changes to this Policy
We may update this Policy when practices, providers or laws change. The current version and effective date will appear on the Website. If a change materially affects how we use information already collected, we will take reasonable steps to notify affected people and obtain consent where required.
