Booking Terms & Conditions
Our commitment to transparent, fair, and professional service agreements
We provide residential and commercial cleaning services through our online Booking site (Services). Our Services connect you with independent cleaning contractors (Cleaning Professionals) who perform cleaning work at your premises.
In these Terms, when we say you or your, we mean you as an individual if you are accepting these Terms for yourself. When we say we, us, or our, we mean Silver Brush Cleaning Australia Pty Ltd.
These terms and conditions form our contract with you and set out our obligations as a service provider and your obligations as a customer. You cannot use the Services unless you agree to these Terms.
Why do we collect your Personal Information?
Please read these Terms carefully before you accept. We draw your attention to:
- our privacy policy (on the Site) which sets out how we will handle your personal information;
- clause 1.6 (Variations) which sets out how we may amend these Terms; and
- clause 15 (Liability) which sets out exclusions and limitations to our liability under these Terms.
We may receive a benefit (which may include a referral fee or a commission) should you visit certain third party websites through a link in the Services.
These Terms do not intend to limit your rights and remedies at law, including any of your Consumer Law Rights.
Engagement and Term
These Terms apply from the time you agree to these Terms, until the date these Terms are terminated in accordance with their Terms (Term).
Subject to your compliance with these Terms, we will provide you with access to the Services.
Where we require access to your premises or computer systems in order to provide the Services, you agree to provide us with such access free from risk to the safety of our employees and contractors.
We will not be responsible for any other services unless expressly set out in these Terms or on our Site.
If we provide you with access to any new or beta services, you acknowledge that because of the developmental nature of such services, you use them at your own risk and we have no obligation to maintain or provide error corrections.
We may amend these Terms at any time, by providing written notice to you. By clicking "I accept" or continuing to use the Services after the notice or 30 days after notification (whichever date is earlier), you agree to the amended Terms.
We will make reasonable efforts to arrive at the scheduled appointment time. However, you acknowledge that arrival times may vary by up to 30 minutes from the scheduled time due to factors beyond our reasonable control.
Bookings and Cancellations
You may book Services through our Site or by contacting us. Your Booking is confirmed once you complete the Booking process. All Bookings have a minimum duration of 2 hours. We reserve the right to decline or cancel any Booking at our discretion.
You may request to cancel or reschedule a Booking by contacting us through your Account or our customer service. For cancellations or rescheduling:
with more than 24 hours' notice before the scheduled service time, no charge will apply;
with less than 24 hours' notice, you will be charged AUD 66 (including GST) cancellation fee;
where the Cleaner is already on site and the job is cancelled or they cannot gain access due to circumstances within your control, you will be charged AUD 165 (including GST).
Price Variations
You may book Services through our Site or by contacting us. Your Booking is confirmed once you complete the Booking process. All Bookings have a minimum duration of 2 hours. We reserve the right to decline or cancel any Booking at our discretion.
property being larger than specified;
property requiring substantially more work than reasonably anticipated;
additional cleaning tasks not included in the original booking; and/or
hazardous or unsafe conditions requiring specialist equipment;
then we may need to adjust the price to reflect the actual work required.
Where possible, our Cleaning Professionals will contact you before commencing additional work that would result in price increases.
Additional services such as oven cleaning, window cleaning, carpet cleaning, or removal of excessive rubbish may incur additional charges.
Any price variations will be based on our standard rates and will reflect the additional time and resources required.

Your Obligations and Acknowledgments
You agree that:
you will provide safe, unobstructed and reasonable access to the premises to be cleaned;
you will provide accurate information about the scope of work required;
you will not be present at the premises if you are suffering from any illness that could risk the Cleaner's health or safety;
you will inform us of any specific requirements, hazards, or conditions at the premises;
you will treat our Cleaning Professionals with respect and maintain a safe working environment. We maintain a zero tolerance policy for misconduct;
you will secure or remove any valuable, fragile, or personal items before the Services commence;
our Cleaning Professionals may take photographs before, during, and after Service completion for quality assurance purposes;
you will report any concerns about damage or loss as soon as possible after service completion, ideally within 48 hours;
you will ensure electricity and running water are available throughout the Service period;
you will move or arrange for the moving of heavy furniture that would impede cleaning access;
our Cleaning Professionals may decline to clean items or areas that pose safety risks; and
you will remove all personal belongings, rubbish, and debris from the premises before Services commence.
You agree to pay our additional costs reasonably incurred as a result of you failing to comply with this clause 4.
Account
You must sign up for an Account in order to access and use the Services.
While you have an Account with us, you agree to:
keep your information up-to-date (and ensure it remains true, accurate and complete);
keep usernames and passwords secure and confidential; and
notify us if you become aware of any unauthorised access to your Account.
If you close your Account, you will lose access to the Services.
Fees
You may choose to purchase Services from us, as set out on our Site (Paid Services). You must pay all amounts due under these Terms.
Details of our Paid Services, including features, limitations and fees are set out on our Site. Payment for Services is due upon completion.
Our payment methods will be set out at the time you purchase the Services.
You must not pay any fees by fraudulent or unlawful means. If you make payment by debit or credit card, you must be the authorised card holder.
If any fees are not paid on time, we may:
suspend your access to the Services; and
suspend your access to the Services; and
If your account remains overdue for more than 30 days, we may engage collection services to recover amounts owing.
You are responsible for paying any taxes associated with your use of the Services.
Rating and Review System
Following completion of the Services, you may rate and review the Cleaner and Services provided. Any ratings or reviews must be honest and accurate.

Availability, Disruption and Downtime
While we strive to always make the Services available to you, we do not make any promises that these will be available 100% of the time.
The Services may interact with, or be reliant on, third party services. To the maximum extent permitted by law, we are not liable for disruptions caused by third parties.
We will try to provide you with reasonable notice of any disruptions to your access to the Services.
Intellectual Property and Data
We own all intellectual property rights in the Services. You agree not to copy or otherwise misuse our intellectual property without our written permission.
We may use any feedback or suggestions that you give us in any manner which we see fit, and no benefit will be owed to you.
This clause 9 will survive the termination or expiry of these Terms.
Transparency & Trust
In these Terms, when we say you or your, we mean you as an individual if you are accepting these Terms for yourself. When we say we, us, or our, we mean Silver Brush Cleaning Australia Pty Ltd.

Confidential Information and Personal Information
While using the Services, you may share confidential information with us. You agree not to use our confidential information, and we agree to do the same for your confidential information.
However, either you or we may share confidential information with legal or regulatory authorities if required by law.
We collect, hold and use any Personal Information you provide to us in accordance with our privacy policy and applicable privacy laws.
You must only disclose Personal Information to us if you have the right to do so.
We may need to disclose Personal Information to third parties, such as our service providers.
Where required by law, we may request certain information from you to meet our requirements.
This clause 10 will survive the termination or expiry of these Terms.
Consumer Law Rights
In some jurisdictions, you may have guarantees, rights or other remedies provided by law (Consumer Law Rights), and these Terms do not restrict your Consumer Law Rights.
We will only be bound by your Consumer Law Rights and the express wording of these Terms.
Subject to your Consumer Law Rights, we do not provide a refund for a change of mind or change in circumstance.
If you accept these Terms in Australia, nothing in these Terms should be interpreted to exclude, restrict or modify the application of the Australian Consumer Law.
This clause 11 will survive the termination or expiry of these Terms.
Quality Assurance and Re-Cleaning
You may request a re-clean if the Services fail to meet reasonable quality expectations.
We encourage you to notify us as soon as practicable after service completion, preferably within 48 hours, and provide photographic evidence where possible.
For bond cleaning services, if your bond is not released due to cleaning issues within our scope, we will arrange additional cleaning at no cost.
If you remain unsatisfied following the re-clean, you may engage a third-party cleaning company. However, any such fees must be reasonable and justified.
Nothing in this clause affects your rights under Australian Consumer Law.
If the customer fails to provide conclusive evidence requiring reclean, no refunds will be sanctioned.
Threats of legal action or damage to our reputation may be used in civil proceedings against you.
Non-Solicitation and Non-Circumvention
During the Term of this Agreement and for 12 months after termination, you must not, without our prior written consent:
engage, employ, or solicit any Cleaning Professionals who performed services for you;
induce any Cleaning Professionals to leave their engagement with us; or
engage in business directly with the Cleaning Professionals in a manner that circumvents our business.
You agree that these restrictions are reasonable and necessary to protect our legitimate business interests.
You acknowledge that monetary damages may not be sufficient remedy for any breach of this clause.
Bond Cleaning Services
If your real estate agent identifies cleaning deficiencies within our service scope, we will return to address these issues at no additional cost.
Our bond cleaning service scope includes all standard cleaning tasks for vacant residential properties.
We recommend that properties be vacant with personal belongings removed to allow full access to all areas.
This commitment operates alongside your rights under Australian Consumer Law.
Liability
You acknowledge that:
you are responsible for securing valuable, fragile, or personal items before Services commence;
we are not liable for damage to items that you have not secured;
if you claim damage occurred, you must provide reasonable evidence;
we will investigate any claims of damage;
where damage occurs, we may investigate through our insurance processes; and
our liability is limited to the amount specified in clause 15.2.
To the maximum extent permitted by law:
neither Party will be liable for any Consequential Loss;
a party's liability will be reduced proportionately to the extent the Liability was caused by the other party;
our Liability is limited to supplying the Services again or paying the cost of having them supplied again; and
our aggregate liability will be limited to the amount of fees paid by you for the relevant Services, or AU$100 if no Services have been purchased.
This clause 15 will survive the termination or expiry of these Terms.
Termination
We may terminate these Terms if:
you fail to pay your fees when due;
you breach these Terms and do not remedy within 14 days;
you breach these Terms and that breach cannot be remedied; or
we decide to discontinue the Services (with 90 days' notice).
You may terminate these Terms if:
we breach these Terms and do not remedy within 14 days; or
we breach these Terms and that breach cannot be remedied.
You may also terminate at any time by notifying us through your Account.
Termination will not affect any other rights or liabilities.
This clause 16 will survive termination or expiry of these Terms.
General
Assignment: You may not transfer these Terms without our consent. We may assign these Terms to a third party.
Disputes: If you have a dispute regarding the quality of Services:
you must notify us as soon as possible;
you must provide reasonable evidence;
we will investigate the matter; and
we will mediate between you and the Cleaner.
Neither party may commence court proceedings without first meeting in good faith to resolve the Dispute.
Events Outside Our Control: We will not be liable for delays caused by events beyond our reasonable control.
Governing law: These Terms are governed by the laws of New South Wales.
Illegal Requests: We reserve the right to refuse any request we deem inappropriate or illegal.
Independent Contractors: The Cleaning Professionals are independent contractors and not our employees.
Marketing: You agree that we may send you electronic communications. You may opt-out at any time.
Nature of Legal Relationship: These Terms do not create a partnership or employment relationship.
Notices: Notices to us must be sent to the email in these Terms. Notices to you will be sent to your Account email.
Publicity: With your written consent, we may advertise that you are a customer.
Definitions
In these Terms:
Account
means an account accessible to the individual or entity who signed up to the Services.
Booking
means a confirmed reservation for Services made through our Site or by contacting us.
Cleaning Professionals
means the independent contractors who provide cleaning services through our Site.
Consequential Loss
includes any consequential loss, indirect loss, loss of profit, revenue, business, or data.
Liability
means any expense, cost, liability, loss, damage, claim, or proceeding.
Personal Information
means any information about an identified or reasonably identifiable individual.
Services
means the services we provide to you, as detailed at the beginning of these Terms.
